Alexandra Marzec

Alex is a highly regarded barrister dealing with libel and slander, misuse of private information, breach of confidence and other publication-related causes of action. She has a busy practice advising both claimants and defendants in relation to libel and privacy issues, being led and acting without a leader.

In 2023 Alex was appointed a Deputy Master of the Kings Bench Division and sits regularly hearing a variety of case management and other matters in that Division.

Alex’s Defendant work includes:

  • From 2009 to 2016, representing parties in the phone-hacking litigation: first, Glenn Mulcaire, a private investigator sued by a great number of claimants for voicemail interception and, from 2014 to 2016, Mirror Group Newspapers sued in respect of the same cause of action, including representing MGN as junior counsel at trial as to damages in March 2015.
  • Defending Penguin Books in a claim brought in relation to a book about the Libor-rigging scandal (Koutsogiannis v Random House).
  • From 2018 to 2020 Alex was part of the counsel team representing Associated Newspapers in the defence of a privacy and copyright claim brought against the Mail on Sunday by Meghan Markle, the Duchess of Sussex.
  • For Defendant publishers, Alex successfully struck out claims in Piepenbrock v ANL (2020), Hayden v ANL (2020) and Vince v ANL (2024)
  • Acting for the Financial Times sued by a international oil company ENRC; the claim was discontinued
  • Acting for Laurence Fox in the trial of a libel claim in which he was both defendant and counterclaimant, concerning a Twitter exchange in 2020 (Blake and Ors. v Fox). The claim is going to appeal in 2025
  • Currently acting for The Guardian in its defence of a libel claim brought by Noel Clarke based on a series of articles concerning “Me Too” allegations. The claim comes to trial in March 2025

At the same time, Alex works for claimants seeking to protect Article 8, libel, privacy and data rights in a wide variety of cases. Sample cases include:

  • In 2016 to 2017, the first (to our knowledge) successful ‘revenge porn’ case brought by a female claimant in respect of the unauthorised posting online of private sexual films.
  • In 2016, representing at trial a claimant who had been falsely accused, by his neighbour, of bestiality with a pig (judgment cited below at Barkhuysen v Hamilton).
  • In 2017, acting for His Royal Highness Prince Louis in an application for reporting restrictions in the course of financial remedies proceedings.
  • In 2019, acting as sole counsel for Mr Jan Serafin in his (successful) appeal to the Court of Appeal against the judgment at the trial of his libel case, on the unusual ground (amongst others) of judicial unfairness. The case went to the Supreme Court, where Alex was led by Adrienne Page KC of 5RB.
  • Acting for Glenn Kline, former Chairman of the FA, in a claim for libel and harassment (2021). The claimant obtained default judgment

  • AAA v Associated Newspapers Limited [2012] EWHC 5137; [2013] EMLR 2 – privacy claim brought by the baby daughter of well-known Conservative politician to try to keep secret her father’s identity
  • Trimingham v Associated Newspapers Limited [2012] EWHC 1296; [2012] 2 All ER 717 – acting for defendant newspaper in a privacy and harassment claim by the partner of former LibDem politician Chris Huhne in respect of articles in the Daily Mail
  • Ontulmus v Collett [2014] EWHC 294 (security for costs); Ontulmus v Collett [2014] EWHC 4117 (costs judgment) – acting for defendant businessman sued for more than £100 million by Turkish entities
  • Gulati and ors. v MGN Limited [2015] EWHC 1422; [2015] WLR (D) 233; [2016] FSR 12 – quantum of damages in “phone-hacking” cases
  • Barkhuysen v Hamilton [2016] EWHC 2858 (main judgment); Barkhuysen v Hamilton EWHC 3371; [2016] 6 Costs LR 1217 (costs) – acting for claimant in a slander/false imprisonment/harassment case where the defendant had made a number of false allegations against her neighbour
